CONSIDERATION: In addition to any entry fee paid, the Signor of this document, on his or her own behalf and on behalf of their heirs, executors, successor in interest, administrators and assigns, hereby agrees to abide by the terms of this Liability Waiver agreement and to forever waive any and all rights to file suit against or seek compensation for damages from Bull Run Festival, LLC an Arizona Limited Liability Corporation, Old Tucson Entertainment, an Arizona Company, American Heritage Railways, a Colorado Company, Pima County and/or any respective principals, members, officers, employees, agents, or assigns, John Hetzel and/or the Spear J Cattle Company, all sponsors of the event, the facility operator, the owner of the property where the Event and related activities occur, and/or any party sponsoring the Event May 2, 3, 4th 2025 (all above named parties collectively referred to herein as the “Event Producers”), as consideration for being allowed by the Event Producers to participate in the Event.

ACKNOWLEDGMENT OF DANGER: Participation in the Event is inherently dangerous and can lead to serious injury or death. Signor acknowledges that participation in the event will expose the Signor to live bulls, which are large, fast, powerful, dangerous, violent, unpredictable animals. The Event further involves running and strenuous physical activity. The Signor understands that participation in the Event may result in their being knocked over, trampled, gored, stomped, or otherwise seriously injured and possibly killed. Signor acknowledges that prior to participating, they may visually inspect the facilities, equipment, livestock, and areas used for the Event, and that they have every right to withdraw from participation should they decide the conditions are too dangerous, but that doing so will not result in the entry fee being refunded. All the terms herein shall remain in full force and effect in the event Signor withdraws from the event at any time.

VOLUNTARY ASSUMPTION OF RISK: Signor, on behalf of his or her own self and their heirs, executors, successors, administrators, and assigns hereby voluntarily assumes any and all risk associated with participation in the Event, including but not limited to risk of death, serious injury, economic loss, or damage to property whether any such loss is caused by Signor’s own actions, the actions of others, the conditions of the facility used for the Event, the rules (or lack thereof) of the Event, the animals involved in the event, or otherwise.

RELEASE FROM LIABILITY: Signor on behalf of his or her own self and their heirs, executors, successors, administrators, and assigns hereby agrees to fully and forever waive, release and discharge the Event Producers from any and all loss, liability, claims, expenses, demands, or causes of action whatsoever, arising out of their participation in the Event or other related activities on the property where the Event is conducted. This waiver and release include loss, liability, claims, expenses, damages or injury resulting from any and all actions or inaction of the Event Producers or from any other cause or causes, whether the same shall arise through their acts or omissions, or those of others.

INDEMNITY: Signor, on behalf of his or her own self and their heirs, executors, successors, administrators, and assigns hereby agree, to the fullest allowable extent under the laws of the State of Arizona, to indemnify and hold harmless the Event Producers from any and all claims, demands, causes of action, damages, costs, expenses, losses or liabilities in law or in equity of any kind or nature whatsoever arising out of or in connection with any injury sustained by the Signer or any person(s) or to the property of any person(s) caused by or in connection with Signor’s participation in the Event. Signor shall at his or her own expense defend all suits, actions, or other legal proceeding that may be instituted by any third party against Event Producers on any such claim, demand, or cause of action. Signor shall further immediately pay and satisfy any judgment that may be rendered against the Event Producers in any such legal action, and reimburse the Event Producers for any legal expenses incurred in connection therewith or in enforcing the indemnity granted in this section.

CONTINUATION OF OBLIGATIONS: Signor agrees and acknowledges that the terms and conditions of this Agreement shall always continue in full force and effect, and shall be binding upon his or her heirs, executors, administrators, assigns or my estate to the fullest extent permitted under the laws of the State of Arizona. The Agreement shall be effective not only for Signors direct participation in the Event, but all related activities occurring on the property where the Event is held.

INSURANCE DISCLAIMER: Signor understands that the Event Producers shall not cover them with medical liability or other insurance for any occurrence arising out of participation in the Event.

MEDICAL EXPENSES: Signor agrees to be solely liable for payment of any and all emergency medical expenses and/or subsequent medical expenses incurred by Signor directly or indirectly as a result of any accident, illness or incapacity, that becomes necessary due to Signor’s participation in the Event or other related activity on the property where the Event takes place, regardless of whether they have authorized such expense. Shall not assert that

SEVERABILITY: If any provisions of this Agreement are held to be invalid or unenforceable, all other provisions shall nevertheless continue in full force and effect.

COPYRIGHT: Signor agrees that any films, photographs, picture slides, movies or videos taken in conjunction with the Event shall not result in their being compensated by the Event Producers. Signor consents to the use of these photographs, pictures, slides, movies or videos by the Event Producers for any legal purposes and surrenders to the Event Producers all copyright in the same.

WILLFUL AGREEMENT: Signor warrants and agree that they clearly understand all the terms and provisions contained in this Agreement, are not relying on any representation, written or oral, expressed or implied, made by any person other than as set forth herein, and acknowledge that this is a binding legal document entered into willfully and freely without any duress. Signor further warrants and represents that they are over the age of 18 and have the full capacity to contract. Signor represents that they are not under the influence of drugs, alcohol, medication, or any other controlled substance of any kind. Signor agrees that this agreement shall be governed by the laws of the State of Arizona, and that any action shall be brought in a court of appropriate jurisdiction in Maricopa County, Arizona.

I, the Signor, have read and understand the above Agreement. I agree to assume all risks associated with participation in the “Bull Run Festival” event at Old Tucson, Arizona. I voluntarily and forever waive my right to sue the Event Producers (as named above), the property owner, and their respective principals, agents, employees, heirs, successors in interest and assigns resulting from any injury, loss, or damages incurred arising out of my participation in the Event, and further agree to indemnify them from the same.
